The 2009 Oregon Legislature passed House Bill 2434, which decreases the statute of ultimate repose period contained in ORS 12.135 from ten years to six years, but only for large commercial structures. This change does not apply to plaintiffs who are public bodies or structures owned or maintained by homeowners associations or associations of unit owners. The new law benefits commercial builders, who now have the same six-year statutory limitation period for both contract and negligence claims. The change goes into effect on January 1, 2010.
