Our client, a general contractor, had previously entered into a release and settlement agreement with a developer. Shortly thereafter, the developer became embroiled in litigation on the project in matters unrelated to our clients' scope of work. More than one year after the settlement agreement was consummated, the developer asserted our client breached the agreement and sought to void the release. Enforcing the release and settlement agreement was very important as our client feared being dragged into the developer's ongoing legal morass. At arbitration, we obtained a complete defense decision. Specifically, the arbitrator found that the settlement agreement was in full force and effect, preserving the full release between the parties, and that no damages were owed by our client to the developer.
